This Agreement is entered into between Atlas Azul and the User and is effective as of the date of electronic acceptance. This Agreement sets forth the general terms and conditions of use of the Direct100 platform and the products and services purchased or accessed through this platform. Whether you are only browsing or using this platform or the Buying Services, your use of this Site and its electronic acceptance of this Agreement means that you have read, understand, acknowledge and agree to be bound by this Agreement.
Direct100 is a software registered by the company Atlas Azul, being made available to the User under license for a period of one year, being automatically renewable for equal periods of time, unless otherwise communicated by Atlas Azul at least 30 days prior to the date of cancellation of the license.
Direct100 is software based on an Internet platform. Its use requires the existence of an Internet access and an Internet browsing browser to use the application.
The Service shall be used in accordance with the law, and may not be used for the attempt or practice of acts constituting civil or criminal liability or, generally, for acts contrary to the Law, public order or good customs.
In order to access some functions of this platform or to use some of the Services, the User will have to create an Account. The User declares and warrants to Atlas Blue that all data presented at the time of creation of his Account is accurate, current and complete and that the User will keep the Account data accurate, current and complete. If Atlas Blue has reason to believe that the User Account data is false, inaccurate or outdated or incomplete, Atlas Azul reserves the right, at its sole discretion, to suspend or terminate the Account the User.
The contents of the messages sent by the User and the personal data of the recipients are and property of the User and Atlas Blue declares not to make a different use from that stipulated in the contract. Atlas Azul does not guarantee that messages will be properly displayed in all recipients' email programs because of the wide variety of HTML generation tools available. Atlas Blue makes every effort to ensure that all e-mail messages that it has sent comply with e-mail rules, but we can not guarantee the consistency of the messages on all e-mail platforms.
Atlas Azul is not responsible for any delay in the delivery of the messages nor for any other damages resulting from the sending of the messages, as well as for the suspension, interruption or any other anomaly of the Service that is not directly attributable to it as a fraud or serious fault, without prejudice to the liability arising therefrom.
The User declares that he / she is aware that to use the platform of sending the messages Direct100 is necessary to have the consent of the recipients of the messages of reception of the same. The consensus has to follow the current norms and be: previous, free and informed. In case the User does not respect this condition Atlas Azul has the right to block the possibility of sending the messages and to terminate the contract.
The User declares to use the Direct100 platform in compliance with the standard on the processing of personal data and the protection of privacy in the electronic communications sector (Law 46/2012).
In case you use the direct100 platform for illegal purposes and / or to send unauthorized publicity, causing Atlas Azul problems such as: registering one or more IP addresses in a Relay Block or International Blacklist list (eg: URIBL, SURBL , SORBS, SPAMCOP, SPAMHAUS, and others), out a blacklisting or relay block list of an Internet Provider (for example, Google, Microsoft, Yahoo !, AOL, Godaddy, Register, Aruba, responsible for the violations and exempts Atlas Azul from any type of liability, which has the right to act in the appropriate offices for the compensation of damages, in relation to itself or third parties, as a result of such behavior.
You represent and warrant that the information you use in an email marketing campaign, including the header, subject line, and content, is not misleading or misleading.
